DSV Quote Terms and Conditions

These terms and conditions ("Terms") apply to the use of DSV Quote Tool operated by the DSV Group ("DSV") and any offer, order, or purchase of transportation and logistics services ("Services") via DSV Quote Tool from any entity within the DSV Group ("DSV Entity").

"Customer" means the company using DSV Quote Tool to offer, order, or purchase services from DSV Entity.

Customer confirms to be a legal entity duly incorporated under law.

It is a condition for the use of DSV Quote Tool that these Terms are accepted.

These Terms are in effect as of 01.02.2023.

  1. DSV Quote Tool - Offer and Acceptance of Services
    1. DSV Quote Tool is made available to Customer's through myDSV. Customer must have a myDSV user in order to use DSV Quote Tool.
    2. DSV Quote Tool is a system for Customer to make invitation to make offer(s) for purchase of Services from DSV Entities.
    3. When Customer makes invitation to make offer, such invitation to make offer will be sent forward to local DSV Entities, who will decide at their sole discretion whether to make an offer based on Customer's invitation to make an offer.
    4. If a DSV Entity makes an offer to Customer through the DSV Quote Tool, the offer is valid for the period stated in the offer. If no period is stated in the offer, the offer is valid for 7 days. However, DSV Entity reserves the right to withdraw the offer at anytime until the time the offer has been accepted in DSV Quote Tool by Customer.
    5. When Customer accepts DSV Entity's offer in DSV Quote Tool, DSV Entity will provide Customer with an order confirmation under Customer's profile in myDSV, and then Customer and the respective DSV Entity will have entered into a binding service agreement ("Service Agreement").
  2. Information in DSV Quote Tool
    1. Customer is asked to provide various information in the DSV Quote Tool when creating invitation to make offer. Customer guarantees the correctness and completeness of any and all information provided in the DSV Quote Tool.
    2. Date and other delivery times provided by Customer, will not be guaranteed by DSV Entity. DSV Entity will do its reasonable best to provide offer based on such dates and times, however, any date and delivery times by DSV Entity are estimates only.
  3. Terms of Services
    1. The Services are subject to the terms and condition stated in the offer. If no terms and conditions are stated in the offer the services is subject to the DSV's standard terms and conditions found on DSV's website, also found here.
    2. It is a condition for accepting the offer in the DSV Quote Tool that the terms and conditions for Services is accepted.
    3. We put to your attention that such terms and conditions for Services limit DSV Entities liability.
    4. Customer's contracting party is the DSV Entity mentioned in the offer and Service Agreement. Only the named DSV Entity will be a party to the Service Agreement and have obligations towards Customer.
    5. DSV Group shall have no joint liability of any kind relating to the Services.
  4. Liability, Access to and use of DSV Quote Tool
    1. DSV shall have no liability for Customer's use or misuse of DSV Quote Tool.
    2. Use of DSV Quote Tool is at your own risk.
    3. Except to the extent expressly prohibited by applicable law, under no circumstances will neither party be liable in contract, tort, negligence, breach of statutory duty or otherwise for any indirect or consequential loss, damage, costs or expenses of any nature whatsoever; or for any loss of actual or anticipated profits, loss of revenue, loss of goodwill and/or business, loss of savings or any other pure economic loss whether direct or indirect.
    4. DSV reserves the right to block Customer's access to and use of DSV Quote Tool at anytime.
    5. DSV reserves the right at any time to do maintenance on DSV Quote Tool at which time the access to and use of the DSV Quote Tool might be limited.
  5. Price and Payment
    1. Prices shown in DSV Quote Tool are excluding VAT and other state levies.
    2. Additional charges for special handling (e.g. temperature, dangerous goods, humidity control, special security, etc.), customs clearance and other add on services, may be charged in addition to prices shown in DSV Quote Tool. We urge you to read the offer and terms and condition included in the offer to find out more, and in case of doubt reach out to the DSV Entity providing the offer.
    3. In addition to the price stated in the DSV Quote Tool, DSV Entity might charge.
    4. Price and payment for services are regulated by the terms and conditions in the Services Agreement, cf. Clause 2.1.
    5. DSV Quote Tool is part of myDSV and no separate charges apply to the use of DSV Quote Tool.
  6. Data Privacy
    1. Customer, and Customer's employees, can read about DSV's processing of personal data in connection with the use of DSV Quote Tool, the data subject's rights and how to make complaints in DSV PRIVACY POLICY FOR THE PROCESSING OF PERSONAL DATA found here.
  7. Law and Jurisdiction
    1. These Terms and purchase of Goods are subject to Danish law, with the expressly and entirely exclusion of the United Nations Convention of Contracts for the International Sale of Goods (CISG).
    2. Any dispute between the parties which cannot be settled out of court is to be assigned to a Danish court.
